Judgment
ORDER The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 417, 406, 506(i), 294(b) of IPC in Crime No. 50 of 2025, seek anticipatory bail.
¶2The allegation against the petitioners is that A1 has developed relationship with the victim lady aged about 40 years and promised to marry her and had a physical relationship with her and also by relying on the very same promise, collected a sum of Rs.7 lakhs and 8.5 sovereigns of gold jewels and subsequently cheated her. Hence the case has been registered.
¶3The learned counsel for the petitioners would submit that already gold jewels were returned to the defacto complainant and first petitioner has not collected any money from the defacto complainant and further it is only a consensual relationship and there is no promise to marry and sexual relationship. Hence, he prays for grant of anticipatory bail to the petitioners. Page3 of 6
¶4The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that investigation in this case is pending and acknowledged receipt of 8.5 sovereigns of gold jewels by the defacto complainant. Hence, opposed to grant anticipatory bail to the petitioners.
¶5Considering the age of the victim as well as petitioners and the fact that gold jewels already returned back and also considering the nature of allegations leveled against the petitioners, this court is of the view that custodial interrogation a case of this nature is not necessary, this court is inclined to grant anticipatory bail to the petitioners with certain conditions.
¶6Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance, within a period of fifteen (15) days from the date on which the order copy made ready, before the learned District Munsif cum Judicial Magistrate, Neyveli, on condition that the petitioner shall execute a separate bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only), with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned, and on further condition:
(a) If the petitioners fails to surrender before the concerned Page4 of 6 Magistrate within a period of fifteen (15) days from the date of receipt of a copy of this order, this order shall stand automatically cancelled;

(c) The petitioners shall report before the respondent police everyday at 10.30 a.m., for a period of two weeks and thereafter, as and when required for interrogation;

State of Kerala [(2005) AIR SCW 5560];
(e) If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS. 20-02-2026 MPA Page5 of 6 To
