Judgment

ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus forbearing respondents 4 and 5 from proceeding further to take possession of the petitioner's land situated in S. Nos. 254/1C and 262/3, Naranapuram Village, Palladam Taluk, Tiruppur District, under the guise of a survey conducted on 06.01.2026.

¶2The petitioner claims to be the absolute owner and cultivator of the lands comprised in S.Nos. 254/1C and 262/3, Naranapuram Village, Palladam Taluk, Tiruppur District, having derived title under a registered partition deed dated 2006 and being in peaceful possession thereof. While a civil suit in O.S. No. 102 of 2025 on the file of the District Munsif Court, Palladam. concerning the subject property is pending, respondents 6 and 7 allegedly obtained survey-related orders in earlier writ proceedings by suppressing material facts and without impleading the petitioner. Pursuant thereto, respondents 4 and 5, with police assistance, conducted a survey, prepared incorrect sketches, and attempted to alter the patta and chitta in favour of respondents 6 and 7, despite Page3 of 6 the pendency of the civil dispute. Aggrieved by the alleged illegal interference with his possession and revenue records, the petitioner has filed the present writ petition seeking a writ of mandamus to restrain the respondents from making any further alterations to the revenue records or interfering with his peaceful possession of the property.

¶3The learned counsel appearing for the private respondents fairly submitted that based on the survey of the land currently in their possession, the private respondents will not take over any land which is presently in the possession of the petitioner till the disposal of the pending suit in O.S. No. 102 of 2025.

¶4In view of the above submissions, this Court is of the view that till the disposal of the suit in O.S. No. 102 of 2025, there shall be an order of status quo that is prevailing as of today to be maintained by both the parties. It is made clear that the Court below shall decide the matter on its own merits, uninfluenced by any observation made herein. It is open to the private respondents to seek recovery of possession, if so advised, by filing an appropriate suit before the competent Civil Court. Page4 of 6

¶5With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs. 24-07-2026 Asi To
