¶2Nithyakumar. D S/o. Deivasigamani, 4/27, Seelampatti, Karumandi Sellipalayam, Erode - 638 052. ..Respondent(s) Prayer: Criminal Original Petition filed under Section 528 of BNSS, to call for the entire records with respect of the FIR in Cr.No.610 of 2025 of the file of the 1st respondent and quash the same by allowing this Criminal Original Petition. For Petitioner(s): Mr.R.Nalliyappan For Respondent(s): Mr.R.Rajasekaran Government Counsel (Crl. Side) for R1 Mr. A.Prithviraj for R2 Page4 of 6 COMMON ORDER These two cases are connected and as such disposed of by the common order.
¶2The Criminal Original Petition in Crl.O.P.No. 4541 of 2026 seeks to quash STC.No.2399 of 2024 on the file of the Judicial Magistrate Court No.III, Erode for alleged offences under Sections 294(b), 323 and 506(i) IPC and Crl.O.P.No.4661 of 2026 seeks to quash FIR in Crime No.610 of 2025 on the file of the 1st respondent for alleged offences under Sections 189(1)(c), 189(2), 189(4), 189(6), 329(3), 296(b), 115(2), 118(1), 324(5), 304(2), 351(3) of BNSS Act, 2023, on the ground of compromise between the parties. The parties are present before the court and, on examination, stand by their compromise and do not want the case to proceed further.
¶2The broad contours of the High Court's power to exercise extraordinary jurisdiction under Section 482 of the Cr.p.c. and Section 528 of the BNSS in respect of compromise of non-compoundable offences are laid down by the Hon'ble Supreme Court of India in Gian Singh -Vs-State of Punjab and Another (2012 10 SCC 303) and other subsequent judgments.
¶3The gist of facts leading to these two cases arise out of the allegations that there is a landlord and tenant relationship between the parties. While so, the Page5 of 6 landlord entered into the tenant's premises and damaged the shop. It is now submitted to the landlord has agreed to repair the damages and that they have ironed out the differences between them.
¶4Thus, it can be seen that this matter is a fit case for the exercise of extraordinary jurisdiction to quash the case on compromise.
¶5Accordingly, the Crl.O.P. No.4541 of 2026 & Crl.O.P.No. 4661 of 2026 stand allowed. The STC.No. 2399 of 2024 on the file of the Judicial Magistrate Court No.III, Erode and FIR in Crime No.610 of 2025 on the file of the 1st respondent / Inspector of Police, Chithode, Erode stand quashed. 14-07-2026 KKN Page6 of 6
