Judgment

ORDER This Writ Petition has been filed seeking a direction to the respondents to pay interest @ 10 percent for the belated payment of Gratuity, Leave Salary and commutation of pension amount to the petitioner.

¶2It is the case of the petitioner that he joined the service of the first respondent Corporation as Driver on 02.08.1992 and had retired from service on

31.05.2024. However, the Provident Fund, Leave Liability and Gratuity Amount have been settled only on 02.12.2025. Therefore, the petitioner claimed 10% interest on the belated settlement of retirement benefits and he has also made representation on 21.01.2026 to pay interest for the belated settlement of retirement benefits which has not evoked any response so far. Hence, the present Writ Petition.

¶3Heard the learned counsels appearing on either side and perused the materials available on record. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.

¶4In view of the limited request made by the petitioner with regard to interest on the belated settlement of retirement benefits, this Court directs the respondents to pay interest at the rate of 6% p.a. for the belated payment of Page3 of 4 retirement benefits as stated supra, from the date of retirement till the date of actual disbursal of the retirement benefits of the petitioner, if there is no impediment in disbursing the same, within a period of six weeks from the date of receipt of a copy of this order, taking into account the bank rate of interest on deposits.

¶5Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. 24-02-2026 Index: Yes/No Speaking/Non-speaking order DP To
