Judgment

O R D E R This Writ Petition has been filed to direct the 1st respondent to act upon the petitioner's representations dated 27.02.2012, 23.06.2022, as well as subsequent representations.

2.The grievance of the petitioner in this Writ Petition is that the 5th respondent has encroached upon the petitioner's property.

3.Admittedly, the 5th respondent has been issued with patta for the property which the petitioner claims he is the owner. Without seeking for cancellation of the said patta standing in the name of the 5th respondent, the petitioner had given representations to the official respondents on the ground that the 5th respondent is an encroacher. Necessarily, the petitioner will have to Page2 of 5 first seek for cancellation of patta standing in the name of the 5th respondent. Since the representations reflected in the prayer to this Writ Petition have not been given for cancellation of the patta standing in the name of the 5th respondent before the competent authority, namely the Revenue Divisional Officer, necessarily, the petitioner will have to give a fresh representation/application to the Revenue Divisional Officer concerned for cancellation of 5th respondent's patta.

4.Mr.S.Arumugam, learned Government Advocate, accepts notice on behalf of the respondents 1, 2 and 4 and Mr.V.Meganathan, learned Government Advocate (Crl. Side), accepts notice on behalf of the 3rd respondent. Since no adverse orders are passed as against the 5th respondent, notice to the 5th respondent is dispensed with by this Court.

5.For the foregoing reasons, this Writ Petition is disposed of by granting liberty to the petitioner to give a fresh representation to the competent authority, namely, the Revenue Divisional Officer, seeking for cancellation of the patta now standing in the name of the 5th respondent, for the property morefully disclosed in the affidavit filed in support of this Writ Petition and once such a representation is received by the competent authority, the said competent authority shall consider the same on merits and in accordance with law and pass final orders after giving due consideration to the supporting documents filed by Page3 of 5 the petitioner. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed. 03-03-2026 Index: Yes/No Speaking/Non-speaking order GSA To
