Judgment

ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondents 1 to 4 to consider the petitioner's representation dated 06.10.2025. Page2 of 6

¶2The case of the petitioner is that he is the absolute owner of land measuring 0.07 Cents in Survey No. 198/37 (currently T.S. No. 64), having acquired the same through a Will executed by his late father. The petitioner's land in T.S. No. 64 has been erroneously classified as Government Poramboke land, despite the petitioner previously holding a rural patta for the corresponding Old Survey No. 198/37. The petitioner approached the 3rd and 4th respondents with a request to survey his land in Old Survey No. 198/37. However, without conducting any physical site inspection, the surveyors orally informed the petitioner that his land had been acquired for road widening. Aggrieved by the willful negligence of the 3rd and 4th respondents, the petitioner approached the 2nd respondent, who subsequently directed the 3rd respondent to provide specific details via a letter dated 04.11.2025. Despite this direction, no action has been taken by the 3rd respondent till date. Subsequently, the petitioner discovered that the 3rd and 4th respondents are attempting to collude with the 5th and 6th respondents by illegally assigning his land to them. Under these circumstances, the petitioner sent a representation dated 06.10.2025 to the first respondent. However, the same has not been considered till date. Hence, the present Writ Petition is filed. Page3 of 6

¶3In reply, Mr. B.Pachaiyappan, learned Government Counsel appearing for the official respondents submitted that the representation of the petitioner dated 06.10.2025 will be considered and appropriate orders would be passed thereon on merits and in accordance with law.

¶4In view of the facts and circumstances of the case and the submissions made by the learned counsel on either side, this Court directs the respondents 1 to 4 to consider the petitioner's representation dated 06.10.2025 on merits and in accordance with law. The respondents 1 to 4 shall conduct a survey of the subject property comprised in Survey No. 198/37 (currently T.S. No. 64) and fix the boundary stones within a period of four (4) weeks from the date of receipt of a copy of this order, after issuing prior notice to the petitioner as well as the 5th and 6th respondents and interested parties, if any. It is made clear that in the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the jurisdictional Police, and the jurisdictional Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court; under no circumstances shall the respondents engage in taking over possession after completing the Page4 of 6 survey to hand it over to any party. Such exercise shall be carried out exclusively through the competent Civil Court.

¶5With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
