Judgment

O R D E R The petitioner herein apprehend arrest at the hands of the respondent police for the offences punishable under Sections 303(2) of BNS in Crime No.07 of 2026, on the file of the respondent Police, seeks anticipatory bail.

¶2The allegation against the petitioner is that the petitioner joining hands with other accused had committed theft of the defacto complainant's goat valued to the tune of Rs.15,000/-. Hence, the case was registered.

¶3The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

¶4The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the stolen goats have been recovered and the petitioner has two previous cases. Hence, he opposed for grant of anticipatory bail to the petitioner.

5.Considering the nature of allegations and the fact that the stolen goats were recovered, this Court is inclined to grant anticipatory bail to the petitioner.

¶6Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on their appearance, within a period of ten days from the date of receipt of a copy of this order, before the learned Judicial Magistrate No.1, Attur on condition that the petitioner shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned, and on further condition that: [a] if the petitioner fails to surrender before the concerned Magistrate within a period of ten days from the date of receipt of a copy of this order, this order shall stand automatically cancelled; [b] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019'].
