Judgment
ORDER This writ petition has been filed to direct the respondents 2 and 3 to conduct survey of the petitioner's property morefully described in the prayer to this writ petition based on the petitioner's online application dated 27.05.2025 within a time frame to be fixed by this Court.
¶2According to the petitioner, despite there being no bar for the respondents 2 and 3 to survey the petitioner's land, since the objections raised by the respondents 4 to 6 have been negatived by the respondents 1 and 2, the petitioner's land has not been surveyed and demarcated till date.
¶3Mr. S.Arumugam, learned Government Advocate accepts notice on behalf of the respondents 1 to 3. Since no adverse orders are passed against the respondents 4 to 6, notice to the respondents 4 to 6 is dispensed with by this Court.
¶4No prejudice would be caused to the respondents if the second respondent surveys and demarcates the boundaries of the petitioner's property morefully described in the prayer to this writ petition after issuing notice to the respondents 4 to 6 and after their objections if any. The petitioner claims that since the objections raised by the respondents 4 to 6 have been negatived by the proceedings of the respondents 1 and 2, there is no bar for the second respondent to survey the petitioner's property.
¶5This Court is not expressing any opinion on the merits of the petitioner's representation.
¶6Accordingly, this writ petition is disposed of in the following manner:-
(a) Before surveying the lands in question, the respondents 2 and 3 are directed to issue notice to the neighbouring land owners, and also to any other party, whom they deem it fit to enquire.
(b) After receiving objections if any and after considering the same, the respondents 2 and 3 shall conduct survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.
