¶2The allegation against the petitioner is that the petitioner is the distance relative of the victim in this case and under the pretext of giving lift to her village, this petitioner took her to lonely place and attempted to rape her which was resisted by the victim and she has rescued her by creating noise and pushed him down and ran away from there and while she was running into the road she was rescued by some of the passers by and later she was taken to her home and thereafter the family members went to the house of the petitioner and pushed him, at that time the petitioner has also attacked the father of the victim. Hence, a complaint was lodged and the case was registered.
¶3The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution; that he is in judicial custody since
08.01.2026; and that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.
¶4The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that is the case of attempt to rape and if the petitioner is enlarged on bail, there is possibility of hampering of investigation process. Hence, he opposed for the grant of bail to the petitioner. Page3 of 5
¶5I have also gone through the FIR and other connected materials and it revealed that though there is a disturbing facts, the petitioner is in judicial custody from 08.01.2026 and considering the above period of incarceration and the fact that the major part of the investigation is almost concluded, this Court is inclined to grant bail to the petitioner with certain conditions.
¶6Accordingly, the petitioner is ordered to be released on bail on their executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each, for a like sum to the satisfaction of the learned Judicial Magistrate, Vandavasi and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019'].
