Judgment

ORDER The Contempt Petition has been filed complaining of the wilful disobedience of the order of this Court dated 04.04.2025 passed in W.P.No.12052 of 2025.

¶2A perusal of the order shows that, in the Writ Petition, this Court had directed the 4th respondent to take up the representation of the petitioner for enquiry, and the said authority under the Ministry of External Affairs was directed to write to the Embassy requesting it to give the petitioner one more chance to appear for the medical fitness test. ¶3It is submitted that, pursuant to the said direction, a Note Verbal dated

01.09.2025 was forwarded to the concerned Embassy. A perusal of the same shows that it has been categorically stated that the petitioner is completely fit and has undergone similar medical tests in other Government as well as private diagnostic centres, which have declared her to be fit, and a request has been made to consider her case.

¶4Therefore, it is for the Embassy of Kuwait to consider the case of the petitioner. This Court cannot issue any direction to a foreign sovereign in exercise of its contempt jurisdiction or in exercise of its jurisdiction under Article 226 of the Constitution of India for granting an employment opportunity to the petitioner.

¶5Therefore, noting that the order has been complied with, the Contempt Petition stands closed. However, liberty is granted to the petitioner to write to the concerned Embassy and ventilate her grievances.
