¶2Now, when the matter is taken up for hearing, the learned Additional Government Pleader appearing for the respondents 1 to 5, after taking instructions, informed the Court that subsequent to the issuance of the said impugned notice, the performance guarantee was furnished and work has also been executed. Therefore, the prayer sought in the Writ Petition has become infructuous as there is no scope for passing the said impugned notice and thereafter, issued a fresh tender.

¶3In such view of the matter, recording the above submission of the learned Additional Government Pleader for the respondents 1 to 5, this Writ Petition is dismissed as infructuous. No costs.
