Judgment
ORDER This Writ Petition has been filed to direct respondents 1 to 3 to demarcate the boundaries of the property, morefully described in the prayer to this writ petition, which according to the petitioners are owned by them, based on their representation, dated 26.11.2023, within a time frame to be fixed by this Court.
¶2The grievance of the petitioners in this writ petition is that though the survey of the property, morefully disclosed in the prayer to this writ petition was completed by the official respondents, the official respondents did not demarcate the boundaries of the property. The petitioners have given a representation on 26.12.2024 for the aforesaid purpose. Since the same has not been considered till date, the petitioners have filed this writ petition.
¶3Mr.R.P.Murugan Raja, learned Government Advocate accepts notice on behalf of respondents 1 to 3. Since no adverse order is being passed against the fourth respondent, notice to the fourth respondent is dispensed with by this Court.
¶4No prejudice would be caused to the respondents, if respondents 1 to 3 are directed to demarcate the boundaries of the petitioners property, Page4 of 6 morefully described in the prayer to this writ petition, after hearing the objections of the 4th respondent and also the neighbouring land owners and any other party as they deem it fit to enquire, within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of in the following manner:-
(a) Before surveying the lands in question, respondents 1 to 3 are directed to issue notice to the 4th respondent and the neighbouring land owners and also any other party whom they deem it fit to put on notice.
(b) After receiving objections if any and after considering the same, respondents 1 to 3 shall demarcate the boundaries of the property, morefully described in the prayer to this writ petition, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order.
