Judgment

O R D E R This writ petition is filed for the following relief: "To direct the respondents herein not to implement the order of the 3rd respondent dated 31.01.2026 in Proceedings No.01/Emp.No.R277/2026/IR/DA-ll pending disposal of the Statutory Appeal of the petitioner dated

14.02.2026 before the 2nd respondent and further direct the 2nd respondent to pass appropriate orders on the Statutory Appeal of the petitioner dated 14.02.2026."

¶2The petitioner, while working as a Manager of REPCO Bank G.T.Branch, Chennai, was subjected to disciplinary proceedings and a charge memo was issued on 25.07.2025. The 4th respondent was appointed as an Enquiry Officer and after an enquiry on 25.11.2025, the 4th respondent filed her enquiry report. The Disciplinary Authority, the 3rd respondent herein, in pursuance to the enquiry report had passed an order in his proceedings No.01/Emp.No.R277/2026/IR/DA-II holding that out of 15 charges leveled against the petitioner, 10 charges were proved and imposed punishment of reduction in rank and re-fixed the salary and emoluments of the petitioner.

¶3Aggrieved by the said order, the petitioner had filed a Statutory Appeal. However, while the appeal before the 2nd respondent is pending, the respondents are taking steps to implement the order of the 3rd respondent from 01.02.2026 onwards, by reducing the rank of the petitioner from Scale I to Scale II. Therefore, the petitioner is before this Court.

¶4It is fairly conceded by the learned Senior Counsel appearing for the respondents that the statutory appeal will be disposed of within a period of 6 weeks.

¶5Recording the submission of the learned Senior Counsel for the respondents, this writ petition is disposed. It is made clear that till the disposal of the statutory appeal, the order dated 31.01.2026 will be kept in abeyance. Consequently, the connected miscellaneous petition is closed. No costs.
