Judgment

ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus to direct the 2nd respondent to issue patta to the petitioner's with respect to their holdings at S. No. 8/2, Paleripattu Village, Kamaraj Nagar, Avadi, Chennai. Page8 of 12

¶2The learned counsel for the petitioner submitted that the petitioners are the residents and owners in possession of lands comprised in S. No. 8/2, Paleripattu Village, Avadi, having purchased the properties under registered sale deeds and constructed residential houses thereon. Despite continuous representations since 2008, the respondents have failed to issue patta in their favour. The first petitioner had earlier obtained a decree in O.S. No. 348 of 2005 from the District Munsif Court, Poonamallee, declaring the subject land as Gramanatham, and no appeal was preferred against the said decree, which has attained finality. Though this Court, in earlier Writ Petitions, directed the respondents to consider the petitioners' claim for issuance of patta, no effective action has been taken. Hence, the present writ petition has been filed seeking a direction to the respondents to issue patta in respect of the petitioners' lands in S. No. 8/2, Paleripattu Village.

¶3Mr. B. Pachaiyappan, learned Government Counsel appearing for the respondents, submitted that the representation submitted by the petitioners in this regard would be considered and appropriate orders would be passed. Such orders will be passed after issuing notice to the petitioners as well as the interested parties concerned, regarding the issuance of patta in favour of the petitioners in terms of the judgment and decree dated 17.01.2006 in O.S.No. 348 of 2005 passed by the District Munsif Court, Poonamallee. ¶4Considering the facts and circumstances of the case and the submissions made on either side, this Court directs the petitioners to produce all documents, including the judgment and decree passed in O.S. No. 348 of 2005, before the second respondent, within a period of two (2) weeks from the date of receipt of a copy of this order. Upon such production, the second respondent / Tahsildar, Avadi Circle, is directed to consider the petitioners' case and pass appropriate orders, after issuing notice to the petitioners as well as the interested parties concerned, on merits and in accordance with law, within a period of ten (10) weeks thereafter.

¶5Wit the above directions, this Writ Petition stands disposed of. There shall be no order as to costs. 17-07-2026 Asi Page10 of 12 To
