Judgment

ORDER This writ petition has been filed to direct the first respondent to cancel patta Nos.4963 and 4964 standing in the name of the respondents 2 and 3 and restore the pattas in the name of the petitioner for the property morefully described in the prayer to this writ petition based on the petitioner's representation dated 28.10.2025 within a time frame to be fixed by this Court.

¶2According to the petitioner, the respondents 2 and 3 have fraudulently and illegally obtained patta Nos.4963 and 4964 in their name. The petitioner seeks for cancellation of the said pattas and for restoration of the pattas in favour of the petitioner. The petitioner had given a representation on 28.10.2025 to the first respondent for the said purpose. Since the said representation has not been considered till date, this writ petition has been filed.

¶3Mr. R. P. Murugan Raja, learned Government Advocate accepts notice on behalf of the first respondent. Since no adverse orders are passed against the respondents 2 and 3, notice to the respondents 2 and 3 is dispensed with by this Court.

¶4Since the petitioner seeks for cancellation of pattas, the competent authority to adjudicate the said representation is the Revenue Divisional Officer, Ponneri. Since the Revenue Divisional Officer, Ponneri has not been arrayed as a party respondent in this writ petition, this Court by exercising its suo motu power impleads the Revenue Divisional Officer, Ponneri as a party fourth respondent in this writ petition. Registry is directed to carry out the necessary amendment. The learned Government Advocate accepts notice on behalf of the newly impleaded fourth respondent as well.

¶5No prejudice would be caused to the respondents if the petitioner's representation as stated supra is considered on merits and in accordance with law after hearing the objections of the respondents 2 and 3 as well as any other third party whom the fourth respondent deems it fit to enquire within a time frame to be fixed by this Court.

¶6This Court is not expressing any opinion on the merits of the petitioner's representation dated 28.10.2025.

¶7For the foregoing reasons, this Court directs the fourth respondent to pass final orders on merits and in accordance with law on the petitioner's representation dated 28.10.2025, seeking for cancellation of patta Nos.4963 and 4964 standing in the name of the respondents 2 and 3 and for restoration of patta in the name of the petitioner for the property morefully described in the prayer to this writ petition within a period of twelve weeks from the date of receipt of a copy of this order after hearing the objections of the respondents 2 and 3 as well as any other third party whom the fourth respondent deems it fit to enquire.

¶8Accordingly, this writ petition is disposed of. No Costs. 24-03-2026 Index:Yes/No Speaking/Non-speaking order Internet:Yes ab To
