WP 10139/2026

Judgment

ORDER The writ petition is filed for the relief set out below: "directing the respondents to pay interest amounts to the petitioner for the belatedly paid Service Gratuity, Leave Salary and Commutation of Pension at the rate of 6% per annum for 16 months of delayed payment in the light of the judgment passed by this Hon'ble Court on 23.10.2024 in W.P.No.30766 of 2024."

¶2It is the case of the petitioner that he had worked as Special Grade Conductor in the respondent-Corporation and had retired from service on

31.05.2018. The petitioner would contend that though the respondents ought to settle all the retiral benefits including Service Gratuity, Leave Salary and Commutation of Pension Amount etc., on the date of the retirement, the same was paid to him only on 19.09.2019 with a delay of 16 months. Therefore, the respondents are legally bound to pay the interest to him. The petitioner made a representation on 23.10.2024 to the respondents to pay the interest at the rate of 12% p.a., for the belated payment of Earned Leave Salary, Gratuity Amount and Pension Commutation Amount. Since the same was not considered to date, the petitioner is before this Court.

¶3Heard the learned Counsel on either side and perused the materials available on records.

¶4Admittedly, the Earned Leave Salary, Gratuity Amount and Pension Commutation Amount has been paid to the petitioner belatedly for no fault of his. Therefore, the petitioner is entitled to the interest on the same. Therefore, a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Earned Leave Salary, Gratuity Amount and Pension Commutation Amount within a period of one (1) month from the date of receipt of a copy of this order. No costs.

¶5With the above directions, the writ petition is disposed of. No costs.
