O R D E R This Writ Petition has been filed challenging the impugned proceedings of the 3rd respondent dated 06.02.2026, calling upon the petitioners to participate in the enquiry conducted by the 3rd respondent pursuant to the directions issued by this Court on 19.12.2025 in the Writ Petition filed by the 5th respondent in W.P.No.49741 of 2025. Interest of the petitioner is adequately protected by this Court's order dated 19.12.2025 passed in W.P.No.49741 of 2025. In the said order, the 3rd respondent has been directed to consider the 5th respondent's application only after hearing the objections of the neighbouring land owners as well as any other third party whom the 3rd respondent deem fit to enquire. The petitioners also claim to be interested parties over the very same property claimed by the 5th respondent. They have been called upon to come for the enquiry under the impugned proceedings of the 3rd respondent dated
06.02.2026. The objections that are raised by the petitioners before this Court has to be raised by them before the 3rd respondent. Instead of raising the same Page2 of 4 before the 3rd respondent, the petitioners have filed this Writ Petition prematurely. Necessarily, the 3rd respondent will also have to strictly abide by the directions issued by this Court on 19.12.2025 in W.P.No.49741 of 2025. Since this Writ Petition has been filed prematurely, this Writ Petition cannot be entertained at this stage.
2.For the foregoing reasons, this Writ Petition is disposed of by directing the petitioners to participate in the enquiry proceedings conducted by the 3rd respondent in compliance of the directions issued by this Court on 19.12.2025 in W.P.No.49741 of 2025, filed by the 5th respondent and thereafter, the 3rd respondent shall pass final orders after holding proper enquiry in terms of the directions issued by this Court in W.P.No.49741 of 2025 and also after giving due considerations and objections raised by the petitioners in this Writ Petition. However, there shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed. 24-03-2026 Index: Yes/No Speaking/Non-speaking order GSA Page3 of 4
