Judgment
ORDER This writ petition has been filed seeking a direction to the respondents 1 to 4 to cancel the patta standing in the name of the 5th respondent for the property more fully disclosed in the prayer of the writ petition and thereafter, issue fresh patta for the very same property in favour of the petitioner based on the petitioner's representation dated 03.12.2018 within the time frame to be fixed by this Court.
¶2The petitioner claims that illegally the 5th respondent obtained patta for the said property and that the petitioner is the absolute owner of the property. The petitioner had given a representation dated 03.12.2018 to the respondents 1 to 4 seeking cancellation of patta standing in the name of the 5th respondent and restoration of the same in the name of the petitioner. Since the Page3 of 5 said representation has not been considered by the respondents, the present writ petition has been filed before this Court.
¶3Mr.C.Jayaprakash, learned Government Advocate, takes notice for respondents 1 to 4. Since no adverse order is being passed against the 5th respondent, notice to the 5th respondent in this writ petition is dispensed with.
¶4No prejudice would be caused to the respondents, if the petitioner's representation as stated supra is considered on merits and in accordance with law, after hearing the objections, if any, from the 5th respondent and any third party, whom the 3rd respondent deems it fit to enquire, within a time frame to be fixed by this Court, by adhering to the principles of natural justice.
¶5This Court is not expressing any opinion on the merits of the petitioner's representation dated 03.12.2018.
¶6For the foregoing reasons, this writ petition is disposed of by directing the 3rd respondent to pass final orders, on merits and in accordance with law on the petitioner's representation dated 03.12.2018, seeking cancellation of patta standing in the name of the 5th respondent for the property morefully disclosed in the affidavit filed in support of this writ petition, after giving due consideration of the supporting documents filed by the petitioner Page4 of 5 and after hearing the objections, if any, from the 5th respondent and any other party, whom the 3rd respondent deems it fit to enquire, within a period of twelve
(12) weeks from the date of receipt of a copy of this order. No costs. 17-03-2026 Index: Yes/No Speaking/Non-speaking order rka Page5 of 5
