Judgment

Order This writ petition has been filed seeking for a direction to the official respondents not to measure the property, morefully described in the prayer to this writ petition till the disposal of the suits in O.S. Nos.49 and 85 of 2025, which are pending before the District Munsif Court, Mettur and the Sub Court, Mettur respectively.

2.The grievance of the petitioner in this writ petition is that without issuing notice to the petitioner, the official respondents are attempting to survey the land, belonging to the petitioner pursuant to the order dated 02.12.2025 passed by this Court in W.P. No.46525 of 2025. In the order dated 02.12.2025 passed by this Court in W.P. No.46525 of 2025, it has been made clear by this Court that before conducting survey, the objections of the rival claimants will have to be heard by the official respondents. Page3 of 4

3.Learned counsel for the petitioner would submit that despite the said direction, the petitioner has not been put on notice by the official respondents before conducting survey of the property.

4.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of the respondents 1 to 6. Since no adverse order is being passed against the seventh respondent, notice to the seventh respondent is dispensed with by this Court.

5.Necessarily, the petitioner, who is a rival claimant will have to be heard by the respondents before conducting survey of the property.

6.For the foregoing reasons, this writ petition is disposed of by directing the third respondent to issue notice to the petitioner before conducting survey of the property and only after hearing the objections of the petitioner, the third respondent shall take a decision with regard to the request made by the petitioner in W.P. No.46525 of 2025 seeking for survey and demarcation of the boundaries, within a period of 12 weeks from the date of receipt of a copy of this order. The third respondent shall strictly adhere to the order dated

02.12.2025 passed by this Court in W.P. No.46525 of 2025. No costs.
