Judgment
ORDER The petitioner seeks issuance of a Writ of Mandamus to direct the third respondent to consider his representation dated 10.02.2026 for recovery of the outstanding loan amount from the retirement benefits of the fourth respondent, the principal borrower, and to discharge him from his liability as guarantor.
¶2The petitioner is working as Junior Assistant in the Puducherry Road Transport Corporation Ltd. The fourth respondent, who was working as a Driver in the said Corporation, became a member of the third respondent Society and availed a loan of Rs.2,09,034/- in the year 2015. The petitioner, being a co-employee and a member of the said society, stood as guarantor for the said loan. Subsequently, the fourth respondent committed default in repayment of the loan, and the loan account was declared irregular in the year 2018. The third respondent Society issued a notice dated 05.07.2018 to the second respondent requesting recovery of the outstanding loan amount from the retirement benefits of the fourth respondent. However, no effective steps were taken to recover the entire loan amount from the terminal benefits and the fourth respondent retired from service on 31.07.2018 upon attaining superannuation. As a portion of the loan amount still remains outstanding, the petitioner submitted a representation dated 10.02.2026 seeking recovery of the outstanding loan amount from the retirement benefits payable to the fourth Page2 of 5 respondent and for discharge of his liability as guarantor. However, no action has been taken on the said representation till date. Hence the present writ petition.
¶3Heard both sides and perused the materials on record.
¶4Considering the facts and circumstances of the case, without going into the merits of the case, this Court directs the second respondent to consider the petitioner's representation dated 10.02.2026, and pass appropriate orders on merits and in accordance with law, within a period of one month from the date of receipt of a copy of this order and communicate the same to the petitioner.
