ORDER This Criminal Original Petition has been filed praying to further investigate the First Information Report in Crime No.8 of 2026, on the file of the second respondent police and file final report. Page2 of 4
2.The petitioner had sent a representation on 02.03.2026 followed by a reminder dated 11.03.2026, but the respondent has not taken any action.
3.The contention of the learned counsel for petitioner is that on
11.01.2026 at about 1.40 p.m., while the petitioner was proceeding in his two-wheeler near Pudhupalaiyam bridge, at that time, a car which was proceeding ahead of him, suddenly stopped the car without any indication. The petitioner followed the car from behind and unable to apply brake. Hence, he dashed against the car, fell down and sustained injuries. The petitioner was initially admitted to Government Hospital, Andhiyur and later shifted to E.M.C. hospital, Erode for further treatment, where he took treatment as inpatient from
11.01.2026 to 28.01.2026. The petitioner applied for insurance, at that time, he came to know that a case was registered against him in Crime No.8 of 2026 for offence under Section 281 and 125(a) of BNS, 2023 on the complaint of one Palanisamy, who is the driver of the car and he had given a false version as though the car was parked on the left side of the road with indicator and the petitioner rammed into the car.
4.The learned Additional Public Prosecutor submitted that in this case now investigation is in progress. As on date, the case proceeds on the complaint of Palanisamy. The vehicle was sent for Motor Vehicle Inspection and report obtained on 22.01.2026. The eyewitness present near the scene of accident confirms that near Balaji Hospital, a two wheeler bearing Registration Page3 of 4 No.TN-38-U-7796 rode by the petitioner collided with the electric car bearing Registration No.TN-33-BZ-6048 from the rear side. According to the eyewitness, the car was parked on the left side with indicator. He further submitted that either the car has been rammed by the petitioner or by applying sudden brake the petitioner rammed on the car, which does not make much difference. The person, who is following the vehicle from behind has to be cautious and maintain sufficient distance and to manoeuvre the situation accordingly. It is an admitted case of the petitioner that the petitioner rammed from behind and in such circumstances making allegations against the driver of the car is not proper. In any event, petitioner's representation would be considered during the investigation.
5.In view of the same, the petitioner to approach the second respondent, produce medical records and also the vehicle and give his explanation. The investigating officer to consider the petitioner's explanation, proceed with investigation and file final report in Crime No.8 of 2026.
6.With the above directions, the Criminal Original Petition is disposed of. Consequently, the connected Criminal Miscellaneous Petition is closed. 21-04-2026 Index: Yes/No Speaking/Non-speaking order RSI Page4 of 4
