Chennakesavulu N v. Azizul Karim

ORDER The learned counsel for the revision petitioners submitted that the plaintiff, being a third party, has filed the suit in O.S. No. 146 of 2017 by suppressing earlier title transactions and sale deeds relating to the suit properties in Survey Nos.1270/1 & 127/2, total extent of 4.45 cents, at Madhavaram village, Thiruvallur District. The revision petitioners are the purchasers, having purchased the property from the ancestors of Mr.Syed Moosa Mohammed Moya, who had rights over the properties based on a settlement deed dated

19.11.2021. He further submitted that the plaintiff and defendants, by colluding with each other, have suppressed all prior transactions relating to the entire extent of the suit properties and have filed the suit as if the properties are intact.

¶2Considering the submissions and on perusal of the sale deeds, leave is granted. Accordingly, this Civil Miscellaneous petition is ordered.
