DISMISSED
Court
High Court of Madras
Decided

Bench
The Chief Justice, G.Arul Murugan
Case no.
WP 12050/2026

Judgment

ORDER (Order of the Court was made by The Chief Justice) This writ petition under Article 226 of the Constitution of India has been filed seeking direction to respondent Nos.1 to 3 not to grant any permission to respondents 4 to 8 to establish stone crushing unit at R.S.No.806/1 in Ponnivadi Village, Dharapuram Taluk in Tiruppur District.

¶2The apprehension of the petitioner is that, the land in question has been purchased by respondent Nos.4 to 8 herein for the purpose of agricultural use, however they intend to establish a stone crushing unit. Adjacent to the above land, temples are situated within 200 metres of the proposed location. No stone crusher can be located within 500 metres of any National Highway or places of religious importance. Therefore, the petitioner has moved a representation before the competent authority.

¶3On a perusal of the writ petition and the materials available on record, it is seen that the petition itself is premature, since neither any documents have been produced to show that respondent Nos.4 to 8 have applied for grant of licence to operate the stone crushing unit, nor any permission has been granted to them for operating such unit.

¶4Therefore, we are of the considered opinion that this writ petition is premature and misconceived. We refrain to entertain this writ petition and accordingly the same is hereby dismissed. No costs.
