ORDER This Writ Petition (Criminal) has been filed challenging the communication issued by the second respondent dated 21.02.2026 and seeking a direction to the respondents 1 and 2 to register an FIR in the complaint lodged by the petitioner dated 05.09.2024. Page3 of 5
¶2Heard the learned counsel appearing on either side and perused the materials available on record.
¶3It is seen that, based on the complaint lodged by the petitioner, the second respondent conducted a detailed enquiry and closed the same by report dated 21.02.2026. Once the complaint has been enquired into and closed by the police, the next option available to the petitioner is only to file a private complaint in the manner known to law. That apart, the complaint lodged by the petitioner was duly enquired into and as per the report submitted by the second respondent dated 21.02.2026, no prima facie case is made out for registration of the FIR. After registration of the FIR, the same was closed as "Mistake of Fact" or "Further Action Dropped". Aggrieved by the same, the petitioner filed a protest petition.
¶4In view of the above, this Court finds no infirmity or illegality in the report submitted by the second respondent. Accordingly, this Writ Petition (Criminal) stands dismissed. However, the petitioner is at liberty to file a private complaint in accordance with law. No costs. 06-08-2026 Index: Yes/No Speaking/Non-speaking order LPP Page4 of 5 To
