Judgment
ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the 3rd respondent to consider the representation dated
30.10.2025 sent on 19.02.2026 for cancelling patta No.4540 dated 11.06.2024 Page2 of 7 situated at Thazhambur Village, Vandalur Taluk, Chengalpattu District, under Section 12 Of The Tamilnadu Patta Pass Book Act 1986.
¶2The learned Senior Counsel appearing for the petitioner submitted that the petitioner is a co-owner of a 10-acre joint property comprised in Survey Nos.84/1A and 84/1B, covered under Joint Patta No.767, situated at Thazhambur Village. The grievance of the petitioner is that, although the property continues to remain undivided, the fifth respondent illegally sub-divided the property as Survey No.84/1A2 and issued Patta No.4540 in favour of the transferee, contrary to Section 44 of the Transfer of Property Act, 1882, under which a transferee of an undivided share acquires only co-ownership rights and not any specific portion of the property.
¶3He further submitted that the petitioner submitted representations and preferred a statutory appeal seeking cancellation of the illegal patta. Though the first respondent directed the competent authority to take appropriate action, no effective steps were taken. Aggrieved by the inaction of the respondents, the petitioner has filed the present writ petition seeking a Writ of Mandamus directing the respondents to consider the petitioner's representation and appeal, Page3 of 7 cancel Patta No.4540 and the illegal sub-division in Survey No.84/1A2, and restore the original Joint Patta No.767 in accordance with law.
¶4According to the learned Senior Counsel, the patta issued in favour of the 7th respondent is against the law laid down by the Hon'ble Supreme Court in the case of Sk.Golam Lalchand Vs. Nandu Lal Shaw alias Nand Lal Keshri alias Nandu Lal Bayes and Others reported in 2024 SCC OnLine Sc 2456.
¶5Heard the learned Senior Counsel appearing for the petitioner and Mr.B.Pachaiyappan, learned Government Counsel for the official respondents.
¶6Considering the facts and circumstances of the case and the submissions made on either side, this Court, without going into the merits of the matter, directs the third respondent / Revenue Divisional Officer, Tambaram, to consider the petitioner's representation dated 30.10.2025 and pass appropriate orders on merits and in accordance with law. Such orders shall be passed after issuing due notice to the petitioner and the seventh respondent, and affording them a reasonable opportunity for a personal hearing, while also taking into consideration the law laid down by the Hon'ble Supreme Court in the case of Sk. Golam Lalchand Vs. Nandu Lal Shaw alias Nand Lal Keshri alias Page4 of 7 Nandu Lal Bayes and Others, reported in 2024 SCC OnLine SC 2456. This exercise shall be completed within a period of eight (8) weeks from the date of receipt of a copy of this order.
¶7With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs. 08-07-2026 Asi To
