Judgment

ORDER The petitioners apprehend arrest for the alleged offences under Sections 296 (b), 115 (2), 118 (1) of BNS, 2023 in Crime No.47 of 2026 on the file of the respondent police seek anticipatory bail.

¶2The case of the prosecution is that due to previous enmity, the petitioners assaulted the defacto-complainant with a knife, causing injuries. Hence, the complaint. Page2 of 6

¶3The learned counsel appearing for the petitioners submitted that the petitioners are innocent and they had been falsely implicated in this case. He further states that the occurrence took place on 18.03.2026. Now, the injured has been discharged from hospital. Hence, he prays to grant anticipatory bail to the petitioners.

4.The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that there are a total of four accused in this case. He stated that due to previous enmity, the petitioners assaulted the defacto-complainant using a knife, their hands and stones. He further submitted that there is also a counter case in Cr.No.46 of 2026. In both cases, the parties sustained injuries, underwent treatment for four days and, were subsequently discharged from hospital. However, he opposed the grant of anticipatory bail to the petitioners.

5.Considering the facts and circumstances of the case, that the injured has been discharged from hospital, this Court is of the firm view that custodial interrogation of the petitioners is not necessary at this length of time. Hence, this Court is inclined to grant anticipatory bail to the petitioners, subject to certain conditions. Page3 of 6

State of Kerala [(2005) AIR SCW 5560];
