ORDER This Writ Petition has been filed to direct the respondents to consider the petitioner's representation dated 17.02.2026.
¶2Learned counsel for the petitioner would submit that the petitioner has made a representation dated 17.02.2026 to survey the subject property situated at Ambothi Village, Annur Taluk, Coimbatore District within registration district of Gobichettipalayam and Sub-registration district of Punjai Puliampatti. However, the same was not considered, as on date. Hence, this writ petition.
¶3Mr.B.Pachaiyappan, learned Government's Counsel, accepts notice on behalf of the respondents and submitted that the petitioner has not filed a Page3 of 5 separate application for sub-division. Unless and until the petitioner files the said application, the respondents are not in a position to carry out the survey of the subject property.
¶4Heard the learned counsel on either side and perused the materials available on record.
¶5In view of the above, this Court without expressing any opinion on the merits of the case, directs the petitioner to file a suitable application for sub-division of subject property, based on the partition deed along with application for survey and demarcation of the subject property, within a period of two weeks from the date of receipt of a copy of this order. Upon such receipt, the respondents are directed to consider the same and carry out a survey and complete the process, after giving prior notice to the petitioner and other aggrieved parties, if any, within a period of twelve (12) weeks thereof.
¶6It is made clear that this order is passed only for the purpose of issuing a direction to the official respondent to conduct a survey and lay boundary stones at the subject land. In the event any dispute arises regarding the possession of the subject property, the same has to be decided by way of filing a suit before the competent Civil Court. Page4 of 5
