Order This Writ Petition has been filed to direct the 2nd respondent to consider the petitioner's petition dated 19/08/2024 for transfer of patta.
¶2The learned counsel for the petitioner submitted that the landed properties, measuring an extent of 69.94 cents comprised in several survey numbers situated at Pachayankuppam and Karaikadu Villages, Cuddalore, belong to the Wakf, viz., Sherkhan Sahib Durga, Cuddalore. The petitioner herein is the Mutawalli of the said Wakf. One late Rathinapillai had entered into an agreement of lease with the then Mutawalli vide a registered Lease Deed dated 06.09.1915 for a period of 99 years, which came to an end on 06.09.2014. However, the legal heirs of the lessee, who are respondents 4 and 5 herein, have got the patta mutated in their favour in respect of the subject property and are currently in possession of the same. Hence, the petitioner presented a representation dated 19.08.2024 before the 1st respondent to cancel the patta granted to the lessee in relation to the subject property. Since the said petition has not been disposed of to date, the petitioner has approached this Court. Page3 of 5
