Kumbakonam Mutual Benefit Fund Nidhi Limited v. Sampath Srinivasan

ORDER This application has been filed seeking to modify the order dated

16.02.2026 made in Application No.158 of 2024 in Application No.16 of 2024 in I.P.No.11 of 2019.

¶2Heard Mr.Adarsh Subramanian, learned counsel appearing for the applicants.

¶3This Court while passing the order in Application No.158 of 2024, directed the applicants to release the deposits held in the name of the respondent. The present application has been filed on the ground that there are certain deposits which are maintained in the joint account of the respondent and one of the delinquents. Therefore, the application seeking for clarification as to whether the order passed by this Court on 16.02.2026 will apply even to those joint accounts held along with the delinquent.

¶4When the order was passed by this Court on 16.02.2026, this Court took into consideration individual cases where the concerned applicant had nothing to do with the alleged commission of offence and accordingly, directed Page5 of 6 KMBF to release the deposit. Therefore, the order passed by this Court on

16.02.2026 confined itself only to those deposits exclusively standing in the name of the concerned respondent and will not apply where a joint account is maintained by the respondent along with one of the delinquents. This clarification will sufficiently take care of the grievance expressed by the applicant.
