Order This writ petition has been filed challenging the impugned refusal slip dated 11.03.2026 passed by the respondent. Page2 of 5
¶2Ms.Anu Ganesan, learned Additional Government Pleader, takes notice on behalf respondents.
¶3By consent of the parties, the main petition is taken up for disposal at the stage of admission itself.
¶4The learned counsel for the petitioner would submit that the petitioner presented a release deed for the purpose of registration which was erroneously refused to be registered by the respondent invoking Section 34-C of the Tamil Nadu (Registration) Amendment Act 2025, on the ground that original parent document has not been produced for the purpose of registration. Hence, the present writ petition has been filed.
¶3Further, he would submit that this Court has already struck down Section 34-C of Registration Act in the case of Ms. Dugars vs. State of Tamil Nadu and Ors. in WP. No. 7415 of 2026 dated 23.06.2026 and therefore, the petitioner is not required to produce the original parent document of sale deed for registration of release Deed.
¶4In reply, the learned Additional Government Pleader appearing for the respondent would also fairly submit that as Section 34-C of the Registration Act Page3 of 5 has been struck down by this Court, there is no requirement of production of the parent document for registration of the partition deed. She would further submit that if the petitioner re-presents the release deed for registration, the same will be considered and disposed after conducting proper enquiry.
¶5Heard the learned counsel for the petitioner as well as the respondent and also perused the entire materials available on record.
¶6In the case on hand, as rightly contended by the petitioner, as Section 34-C of the Registration Act has been struck down by this Court, there is no requirement of the parent document for registration of the release deed. Therefore, this Court feels that it would be appropriate to set aside the impugned refusal check slip.
¶7Accordingly, the impugned refusal Check Slip dated 11.03.2026 is hereby set aside and the petitioner is directed to re-present the release deed dated 11.03.2026 for registration. Upon such re-presentation, the respondent shall register the same without insisting of the parent document for registration of the release deed dated 11.03.2026, within a period of one week from the date of re-presentation.
