In all cases For Petitioner(s): Mr.N.Ishak For Respondent(s): Mrs.S.Pavithra, Standing Counsel for R1-2 Mr.C.S.K.Sathish, Standing Counsel for R3 COMMON ORDER The writ petitions are filed for the relief set out below: "directing the respondents to pay interest amounts to the petitioners for the belatedly paid Service Gratuity, provident fund, Leave Salary and Commutation of pension along with the arrears payable on account of 15th wage settlement at the rate of 6 percent per annum for the said period of months of delayed payment in the light of the judgment passed by this Court on

23.10.2024 in W.P. no 30766 of 2024 by considering the representation of the petitioners on various dates."

¶2It is the case of the petitioners that they were appointed as Driver, Conductor and Junior Tradesman in the Respondent Corporation and retired Page4 of 7 from service on attaining the age of superannuation. After their retirement, the respondents settled their terminal benefits belatedly after several months, based on last salary paid to them. Therefore, the respondents are legally entitled to pay the interest to the same. While so, the 15th wage settlement was implemented and wage revision was given effect. Therefore, the respondents has to revise the pension, difference in leave salary and gratuity and settle the same.

¶3The petitioners had made a representation to the respondents to pay them the interest for the belated period along with the arrears payable on account of implementation of 15th wage settlement with 6% interest. However, the same had not been considered to date by the respondents. Hence, the petitioners are before this Court.

¶4Heard the learned Counsel on either side and perused the records.

¶5Considering the limited request of the petitioners and taking note of the fact that the petitioners' representation dated 18.03.2026, 16.03.2026 and

18.03.2026 respectively has not been considered to date by the Respondents, a mandamus, is therefore, directing the respondents to pay 6% interest amount to the Petitioner for belatedly paid Service Gratuity, Provident Fund, Leave Salary and Commutation of Pension for the delayed period to the petitioners and to pay eligible amount if any, under the 15th wage settlement along with interest at the rate of 6% per annum for the delayed period within a period of six weeks from Page5 of 7 the date of receipt of a copy of this order.
