O R D E R This Criminal Original Petition has been filed to quash the proceedings in C.C.No.5167 of 2025 on the file of the Additional Mahila Court at Coimbatore and to quash the Final Report filed under Section 193 of BNSS by the Prosecution therein.

¶2Heard the learned Counsel appearing on either side and perused the materials placed on record.

¶3The case of the prosecution is that a complaint was made as against the 1st accused, who is residing at the first floor of the house and he in an inebriated state abused the defacto complainant and abused her with obscene words, came to the second floor at 3.00 pm on 10.01.2025 and broke down the cell phone used by her and dashed her by pulling her hair to the wall and the 2nd accused also came there and scolded her and assaulted her. Further, it was alleged that she informed her husband and he took her and admitted to the Government Hospital, Coimbatore. It was further alleged that said occurrence was taken place on 10.01.2025 at about 3.00 p.m., and a communication received by the 1st respondent from the Government Hospital, Coimbatore, the 1st respondent proceeded to the Government Hospital and after recording the statement from the 2nd respondent-defacto complainant, the 1st respondent registered the FIR on

14.01.2025 in Crime No.9 of 2025 for the offences punishable under Section 296(b), 324(2) and 115(1) of BNS 2023 read with Section 4 of the Prohibition of Harassment of Women Act, 2002. After completion of investigation, the 1st respondent filed final report and the same has been taken cognizance by the Trial Court in C.C.No.5167 of 2025.

¶4On perusal of the records, it is revealed that the petitioner and 2nd respondent are close relatives residing in the same compound wall and there was a quarrel between them and during the quarrel a fight was ensued. However, no injury was sustained by anybody. Further, though notice was served on the 2nd respondent and her name is also printed in the cause-list, no one appeared on behalf of the 2nd respondent before this Court either in person or through pleader.

¶5That apart, all the allegations are civil in nature and in order to meet the ends of justice, this Court is inclined to quash the entire proceedings in C.C.No.5167 of 2025 on the file of the Additional Mahila Court at Coimbatore.

¶6Accordingly, the proceedings in C.C.No.5167 of 2025 on the file of the Additional Mahila Court at Coimbatore is quashed and the Criminal Original Petition is allowed. Consequently, the connected Miscellaneous Petition is closed.
