Judgment

ORDER This petition has been filed by the petitioner seeking direction to the second respondent not to harass the petitioner and his family members without any due process of law.

¶2From the materials available on record it is seen that the petitioner and the counter complainant one Velayutham had some financial dealings and the petitioner is said to have given loan for a sum of Rs.5,00,000/- to the counter complainant and in return, he had been charging interest and received a sum of Rs.30 Lakhs from Velayutham, however, he did not hand over the signed cheque, promissory note and other documents. Hence, a complaint is said to have been given by the counter petitioner.

¶3The contention of the petitioner is that the respondent police, under the guise of investigation, had been unnecessarily harassing the petitioner by calling him to appear before the respondent police.

¶4The learned Additional Public Prosecutor takes notice for R1 and R2 and submits that on the complaint given by Velayutham, a case has been Page3 of 4 registered in C.S.R.No.136 of 2026 and the petitioner had been called for investigation and he also appeared and given his explanation. Now the counter petitioner had taken time to produce certain documents. In the meanwhile the petitioner had filed this petition.

¶4Considering the submissions and the materials available on record, it is seen that a case has been registered in C.S.R.No.136 of 2026 against the petitioner and the same is pending. In view of the same, this court is of the view that there is no harassment against the petitioner. The respondent police shall issue notice for the appearance of the petitioner for any clarification, if required and the petitioner is directed to co-operate with the enquiry.

¶5In view of the above, this Criminal Original Petition is disposed. 28-04-2026 Index: Yes/No Speaking/Non-speaking order BKN To:
