Judgment
ORDER This application has been filed by the plaintiffs in Transfer C.S.No.135 of 2022 seeking permission to introduce further documents while tendering evidence in their status as defendants in T.O.S.No.3 of 2020.
¶2The evidence of the plaintiffs in T.O.S.No.3 of 2020 had been recorded in entirety. Now it is a turn of the defendants /plaintiffs in Transfer C.S.No.135 of 2025 to tender evidence. A string of documents have been appended to the Judges Summons and they include ten medical records, one report filed by the Tamilnadu State Commissioner for Women, one CSR issued by the Abiramapuram Police Station and a Marriage Registration Confirmation Letter.
¶3The medical records would not advance the case to either prove the will or disprove the Will. They may be important documents viewed from the view point of the parties. But so far as the issues to be decided in the testimonial suit or in a civil suit are concerned, they may not be directly relevant. Similarly, report filed by the Tamilnadu State Commissioner for Women or the CSR issued by the Abiramapuram Police Station, again would not assist the Court either proving or disproving the Will.
¶4One document which is a Marriage Registration Confirmation Letter, the learned counsel stats that in the Will, it had been mentioned that the granddaughters have already married but the marriage of one daughter took place after the execution of the Will.
¶5The learned counsel for the respondents recorded objections and stated the documents will have to be marked subject to proof, relevancy and admissibility.
¶6Any further objections can be raised during the cross examination of the witness, who produces this Marriage Registration Confirmation Letter dated 25.09.2024. This application is partly allowed restricting introduction of this one document viz., Marriage Registration confirmation letter dated 25.09.2024 and the original should be produced and marked during the course of examination of evidence. The other documents are not permitted to be marked. 30-06-2025
