ORDER This Transfer Civil Miscellaneous Petition has been filed to withdraw the case in H.M.O.P.No.34 of 2026 on the file of the Sub Court, Uthangarai and transfer the same to the Family Court, Vellore. Page2 of 6
.Heard both sides and perused the materials available on record.
.Learned counsel for the petitioner submits that the respondent filed a petition in H.M.O.P. No. 34 of 2026 before the Sub Court, Uthangarai, seeking dissolution of marriage. She submits that the petitioner has two major sons and resides in Vellore Town and District. Further, the petitioner is unemployed, has no independent source of income, and was entirely dependent on her aged parents for her livelihood, both of whom are now deceased. She further submits that the petitioner currently resides with her sister's family and is struggling to meet her day-to-day needs. Furthermore, the petitioner suffers from severe health complications, rendering her unable to travel a distance of approximately 115 kilometres for every hearing to attend the court proceedings before the Sub Court, Uthangarai. If the case is not transferred, the petitioner will be subjected to immense prejudice, grave hardship, mental agony, inconvenience, and irreparable loss. Therefore, she prays for the transfer of the case to the Family Court, Vellore.
.Learned counsel for the respondent has not raised serious objection in transferring the case from Sub Court, Uthangarai to Family Court, Vellore. Page3 of 6
.I have gone through the affidavit filed in support of the transfer petition as well. I find merit in the submissions made by the learned counsel on either side.
.Considering the facts and circumstances of the case, the submissions made by the learned counsel on either side, and the fact that the petitioner has severe health complications, this Court is inclined to transfer the case from the file of the Sub Court, Uthangarai, to the file of the Family Court, Krishnagiri. Accordingly, the case in H.M.O.P. No. 34 of 2026 is hereby withdrawn from the file of the Sub Court, Uthangarai, and transferred to the file of the Family Court, Krishnagiri. Upon receipt of the case papers from the Sub Court, Uthangarai, the Family Court, Krishnagiri, is directed to issue notice to both parties within four weeks. After due service of notice, the Family Court, Krishnagiri, is directed to proceed with the matter in accordance with the law.
.Considering the facts and circumstances of the case, this Court is inclined to permit both parties to appear through video conferencing mode before the Family Court, Krishnagiri. However, it is made clear that both parties shall appear in person before the Family Court, Krishnagiri, as and when required. Page4 of 6
.With the above directions, this Transfer Civil Miscellaneous Petition is allowed. No costs. Consequently, connected Civil Miscellaneous Petition is closed. 25-06-2026 Index: Yes/No Speaking/Non-speaking order PAM Page5 of 6 To
