¶2Heard the learned counsel appearing on either side and perused the materials available on record.
¶3The petitioners joined the service of the respondent corporation and retired as Driving Instructor and Special Grade Conductor. Subsequently, the 14th Wage Settlement was entered into between the Management and the Trade Unions on 24.08.2022, pursuant to which the wages and pension were also revised with effect from 01.09.2019. Since the petitioners had retired on 30.09.2020 and 30.06.2022 respectively, they are entitled to the difference in leave salary and gratuity from 01.09.2019 till the date of retirement and to revise the salary and all the retirement Page3 of 4 benefits of the petitioners as per the 14th Wage Settlement. However, the said representation has not been considered so far.
¶4In view of the above, the respondents are directed to pay the applicable differential amount in leave salary and gratuity from 01.09.2019 till the date of retirement and to revise the salary and all the retirement benefits of the petitioners, in accordance with the 14th wage settlement dated 24.08.2022, together with interest at the rate of 6% per annum, within a period of twelve weeks from the date of receipt of a copy of this order.
