Judgment

ORDER The present Writ Petition has been filed seeking the issuance of writ of Mandamus directing the 1st respondent to consider the petitioner's application dated 03.02.2026.

¶2The learned counsel for the petitioner submitted that the petitioner is the owner of the property situated in Vellakkarai Village, Cuddalore District, comprised in New Survey No. 446/5, having purchased the same under a registered Sale Deed dated 21.11.2005 (Document No. 3185 of 2005). The revenue records, including property tax and electricity service connection, stand Page2 of 5 in the name of the petitioner's husband, and the petitioner has constructed a residential house on the property.

¶3Under these circumstances, the petitioner submitted an application dated 03.02.2026 to the first respondent seeking a survey of the property. Despite receiving the application and the requisite charges, the first respondent has failed to conduct the survey or pass any orders thereon. Aggrieved by this inaction, the petitioner has filed the present writ petition seeking appropriate directions.

¶4The learned Government Counsel appearing for the first respondent submitted that the survey number of the subject property mentioned in the petitioner's application does not match official records. While acknowledging that the petitioner owns a certain portion of the subject property, the learned counsel contended that the application is defective. Consequently, the petitioner must file a fresh representation seeking subdivision of the property, followed by an application for the issuance of a separate patta. Page3 of 5

¶5Considering the facts and circumstances of the case and the submissions made by both sides, this Court, without going into the merits of the matter, directs the petitioner to file a fresh representation. Upon submission of such representation, the 1st respondent shall afford a fair hearing to the parties, after issuing due notice to the petitioner and the private respondents and pass appropriate orders on the merits and in accordance with law.

¶6With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs. 13-07-2026 Asi To The Land Surveyor O/o.The Tahsildar Cuddalore Taluk and District. Page4 of 5 WPoNo.o18204oofo2026 KRISHNANoRAMASAMY,oJ. Asi WPoNo.o18204oofo2026 13-07-2026 Page5oofo5
