Judgment
ORDER The petitioner, who apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 4(1)(C), 4(1)(A) and 14(A) of Tamil Nadu Prohibition (Amendment) Act, 2024 in Crime No.36 of 2026 on the file of the respondent Police, seeks anticipatory bail.
¶2The learned counsel for the petitioner, pleading innocence on the part of the petitioner and false implication in the case, seeks the indulgence of this Page2 of 5 Court. He submits that the petitioner is arrayed as A1 in this case and that the respondent police seized the property only from A2 and A3. Only based on the confession statement of A2, the petitioner was falsely implicated in this case by the respondent police. The learned counsel further contends that the petitioner will not abscond and is ready to abide by any condition imposed by this Court. Hence, he prays for the grant of anticipatory bail to the petitioner
¶3The case of the prosecution, as put forth by the learned Government Advocate (Criminal Side) appearing for the respondent police while opposing the grant of anticipatory bail, is that the petitioner, along with other accused, was found in illegal possession of 10 brandy bottles (180 ml). He further submits that one previous case is pending against the petitioner.
¶4Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondent and perused the materials available on record.
¶5Taking note of the facts and circumstances of the case and the submissions made by the learned counsel on either side, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Page3 of 5
