Judgment

ORDER The petitioner, who was arrested and remanded to judicial custody on

10.02.2026 for the alleged offences under Sections 8 (c), 20 (b) (ii) (C), 25 and 29 (1) of NDPS Act, 1985, in Crime No.61 of 2026 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner, along with the other accused was found in illegal possession of 22.200 kg of Ganja. Hence the case. Page2 of 4

3.The learned counsel for the petitioner submitted that the petitioner is innocent and has been in custody since 10.02.2026. He further submitted that there are five accused persons in total and the petitioner is arrayed as A4. He contended that the recovery was made solely from the car and no recovery was effected from the petitioner. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate for investigation. Hence, he prays to grant bail to the petitioner.

4.The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the entire 22.200 kg of Ganja was recovered from A1 to A5 while it was being transported in a Baleno car bearing Registration No.TN 42 AR 6089. He further submitted that the contraband was purchased at Perundurai from an unknown person hailing from Odisha, with an intent to sell it in the local area for personal gain. He strongly opposed the bail application on the ground that, as a commercial quantity is involved, the rigour under Section 37 of the NDPS Act is attracted. Hence, he opposed for grant of bail to the petitioner.

5.As rightly submitted by the learned Government Advocate, the petitioner along with the other accused was travelling in a car from which the respondent recovered 22.200 kg of Ganja. This is a huge quantity that falls within the definition of a commercial quantity; therefore, as rightly contended Page3 of 4 by the learned Government Advocate, the petitioner has not putforth any grounds to overcome the rigour of Section 37 of the NDPS Act. Hence, the Criminal Original Petition is dismissed. 08-07-2026 ep Page4 of 4
