ORDER This writ petition has been filed seeking a writ of mandamus directing the respondents 1 and 2 to consider the petitioner's representation dated 05.08.2024 and issue a No Objection Certificate for registration of land comprised in Survey No.226/4, New Survey No.226/4A2 in Mathur Village, Vembakkam Taluk, Tiruvannamalai District, in her name, within a time frame.

¶2Learned counsel for the petitioner would submit that the petitioner is the owner of the aforesaid land even as per the records maintained by the respondents 3 and 4 and she has been in possession and enjoyment of the same ever since the date of its purchase; yet, the aforesaid land is shown as Depressed Class land in the Government records, owing to which, when the petitioner approached the fifth respondent (Sub Registrar) to sell her land to a third party, the said authority refused to register the same on the ground that it is shown as Depressed Class land; aggrieved, the petitioner addressed a representation dated

05.08.2024 to the respondents 1 to 4 to pass an order declaring that her land is not a Depressed Class land and that there is no objection for registration of the same and also followed it up with a reminder dated 17.10.2024 addressed to the second respondent; yet, no orders have been passed on her representation; hence, this writ petition seeking the aforesaid relief.

¶3Mrs. Indhu Karunakaran, learned Government Counsel, accepts notice for respondents 1 to 4 and Mr. M. Roshan Atiq, learned Government Counsel, accepts notice for the fifth respondent. Learned Government Counsel for respondents 1 to 4 submitted that the petitioner's representation dated

05.08.2024 will be considered by the second respondent within a period of six weeks.

¶4Heard the learned counsel on either side and perused the materials available on record.

¶5Considering the limited scope of the relief sought in this writ petition, this Court, without expressing any opinion on the merits of the case, directs the second respondent to consider and pass appropriate orders on the petitioner's representation dated 05.08.2024, after issuing due notice to the petitioner and other aggrieved persons, if any, on its own merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
