ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus to direct the 3rd and 4th respondents to consider the petitioner's representation dated 14.11.2025.
¶2The case of the petitioner is that the subject matter of the dispute involves 5.42 acres of land in Neduvaakottai village, Mannargudi Taluk, which was originally purchased by Marudaayi Ammal and subsequently devolved upon her husband, Govindasamy, who died without legal heirs from that marriage. Govindasamy later remarried and had eight children; thereafter, in Page2 of 6 2001, the petitioner's father purchased the land, obtained possession, and mutated the revenue records in his name. The 5th respondent, one of Govindasamy's sons, disputed this sale, leading to a series of civil litigations where a subsequent First Appeal was decided in the 5th respondent's favour. The petitioner's father challenged this via a Second Appeal (S.A. No. 781 of 2008) before this Court, but he passed away on 24.04.2020, during its pendency, causing the appeal to abate; applications to set aside the abatement and bring the petitioner and other legal heirs on record are currently pending hearing.
¶3While the civil dispute remained unresolved, the 5th respondent willfully suppressed the order of this Court—which directed that revenue remedies could only follow the finality of the second appeal—and filed a consumer complaint (C.C. No. 70 of 2024) to fraudulently mutate the patta in his own favour. The petitioner successfully challenged this unauthorized order before the this Court in C.R.P. No. 2809 of 2025, which officially quashed the Consumer Commission's order on 30.07.2025. Following the quashing order, the petitioner submitted a representation to the official respondents on
14.11.2025, seeking to restore the patta to its original status in favour of his father. Due to the continued failure of the revenue authorities to act upon this representation and restore the patta, the petitioner has approached this Court with the present writ petition. Page3 of 6
¶4Heard Ms.Inthu Karunakaran, learned Government Counsel for the respondents 1 to 4 and Mr.B.Jawahar, learned counsel for the 5th respondent.
¶5Considering the facts and circumstances of the case and the submissions made on either side, this Court, without expressing any opinion on the merits of the matter, directs the respondents 3 and 4 to consider the petitioner's representation dated 14.11.2025 seeking restoration of the patta in favour of the petitioner's father, and pass appropriate orders on merits and in accordance with law taking into consideration the order passed by this Court in C.R.P.No.2809 of 2025 dated 30.07.2025. Such orders shall be passed after issuing due notice to the petitioner as well as the 5th respondent and affording them an opportunity of a personal hearing, within a period of eight (8) weeks from the date of receipt of a copy of this order.
¶6With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs. 08-07-2026 Asi Page4 of 6 To
