Muthu v. Venkatesan

Order Challenging the ex parte order passed in I.A. No. 3 of 2026 in O.S. No. 95 of 2026 on the file of the learned Trial Judge, the plaintiff has filed the present Civil Revision Petition.

¶2The learned counsel for the petitioner would submit that the petitioner, as plaintiff, had filed the said application seeking temporary injunction as against defendants 29 and 30. The trial Court, instead of either granting or refusing interim relief, has discussed the merits of the matter in detail and arrived at a conclusion that no prima facie case is made out and that the balance of convenience is not in favour of the plaintiff, but has nevertheless issued notice to the respondents. According to the learned counsel, such a course Page14 of 16 adopted by the trial Court is procedurally erroneous.

¶3On perusal of the impugned order, it is seen that the learned Trial Judge has adverted to the documents marked as D1 to D20 and recorded findings to the effect that no prima facie case is made out and that the balance of convenience is not in favour of the plaintiff. Having rendered such findings on merits, the trial Court ought to have disposed of the application itself. Instead, the trial Court has chosen to issue notice, which reflects inconsistency in the approach adopted. Further, the basis on which the trial Court has arrived at its conclusions with reference to documents D1 to D20 is not clearly spelt out. Such an approach cannot be sustained.

¶4In view of the above discussion, this Civil Revision Petition is disposed of with the following directions:

(i) the impugned order is set aside. The learned Trial Judge is directed to dispose of I.A. No. 3 of 2026 in O.S. No. 95 of 2026 afresh, on merits and in accordance with law, after affording opportunity to all parties, within a period of eight (8) weeks from the date of receipt of a copy of this order.

(ii) Till such time, the parties shall maintain status quo as on date. Page15 of 16

(iv) There shall be no order as to costs.
