Judgment
Order This Writ Petition has been filed to direct the 6th respondent to take action on the representation of the petitioner dated 20.01.2025to restore patta in his name, in respect of his property, after affording opportunity of hearing to the petitioner.
¶2The learned counsel for the petitioner submitted that the petitioner is the absolute owner of the property measuring an extent of 3 acres and 21,844 sq. ft. comprised in Old T.S.No. 152/2, and another 3 acres and 21,750 sq. ft. comprised in Old T.S.No. 163, totaling an extent of 7 acres and 34 sq. ft., situated at Krishnarayapuram Village, Coimbatore North Taluk, by virtue of a Settlement Deed dated 12.05.1969 executed by his mother. Subsequently, the petitioner developed a layout over an extent of 8.57 acres, named "Balaji Nagar Page3 of 6 Layout". The petitioner also executed a registered Gift Deed dated 03.04.1973, gifting the roads earmarked within the said layout to the local authority.
¶3While the matter stood thus, the 2nd respondent appears to have conceived a 60-foot scheme road in Krishnarayapuram Village; however, the same was never approved by the Government. All of a sudden, the property comprised in Old T.S.Nos. 162 (part) and 163 (part), corresponding to New Town S.F.No. 4853, measuring an extent of 1,818 sq. mt.—which includes the petitioner's property measuring about 19 cents in Old T.S.No. 163—has been classified as a "60-foot road" in the revenue records.
¶4Subsequently, during October 2024, the officials of the 4th respondent attempted to fence the entire extent of the land, under the guise that the said land belongs to the Coimbatore Corporation. Aggrieved by this, the petitioner submitted a detailed representation dated 23.10.2024 to the 4th respondent, requesting them not to interfere with his peaceful possession and enjoyment. Furthermore, when the petitioner verified the Town Survey Land Register
(TSLR) extract, he found that the subject property had been recorded in the name of the 4th respondent/Coimbatore Corporation. This revenue entry was mutated without issuing any notice or affording an opportunity of a hearing to the petitioner. Page4 of 6
¶5Consequently, the petitioner submitted another detailed representation dated 20.01.2025 to the respondents herein, requesting the restoration of the patta in his name in respect of the subject property. Since the said representation has not been considered to date, the petitioner has approached this Court by way of the present Writ Petition.
¶6In reply, the learned Government Counsel appearing for the respondents 1 to 3 submitted that the petitioner's representation dated
20.01.2025 will be disposed of by the 6th respondent within a period of six weeks.
¶7Heard the learned counsel for the petitioner and the learned Government Counsel for the respondents and also perused the materials available on record.
¶8In view of the above, this Court without going into the merits of the matter, directs the 6th respondent to consider the petitioner's representationn dated 20.01.2025 on its own merits and dispose of the same in accordance with law within a period of six weeks from the date of receipt of copy of this order, after issuing notice to the petitioner and shall afford him with an opportunity of personal hearing.
