Judgment

O R D E R This civil revision petition has been filed challenging the impugned order dated 03.02.2026 passed by the Additional District Munsif Court, Namakkal in I.A.No.12 of 2025 in O.S.No.544 of 2013.

¶2In the aforesaid order, the application filed by the respondents / defendants seeking to condone the delay in filing the additional documents under Order VIII Rule 1(A) 3, has been allowed.

¶3According to the petitioner, who is the plaintiff in the suit, no sufficient cause has been shown by the respondents / defendants in filing I.A.No.12 of 2025 seeking to condone the delay in filing the additional 2\5 documents. The petitioner also disputes the additional documents produced by the respondents through I.A.No.12 of 2025.

¶4The suit is of the year 2013. At this stage, if this Court interferes with the impugned order which has been passed only for granting leave for the respondents to file additional documents and when the rights of the petitioner, who is the plaintiff has not been defeated by the impugned order as the petitioner is always having the right to cross-examine the respondents' witnesses with regard to the additional documents filed by them and also dispute the said documents at the time of arguments in the suit. If this Court issues notice to the respondents in this civil revision petition, it will only delay the disposal of the suit, which is not in the interest of the parties to the dispute.

¶5Therefore, in the interest of justice, without examining the merits of the impugned order and to protect the interests of the petitioner, this Civil Revision Petition is disposed of by granting liberty to the petitioner to raise all objections during the cross-examination of the 3\5 respondents' witnesses with regard to the additional documents filed by the respondents / defendants through I.A.No.12 of 2025. The petitioner is also permitted to raise all objections at the time of arguments in the main suit and the trial Court shall consider those objections while pronouncing the judgment in the main suit.

¶6Since no adverse orders are passed against the respondents in this civil revision petition, notice to the respondents is dispensed with by this Court. No costs. Connected miscellaneous petition is closed.
