Judgment
Order This Writ Petition has been filed seeking a direction to the respondents to forthwith forward and refer the petitioner's representation dated 29.09.2025, raised in respect of the land acquisition Award, to the Principal District Judge, Tiruvallur, for the determination of fair and enhanced compensation.
¶2The learned counsel for the petitioner submitted that the respondents determined the compensation amount mechanically, without properly considering the recurring rental income and future earning capacity of the commercial property in question. Dissatisfied with the determination, the petitioner submitted a detailed written objection dated 29.09.2025, disputing the Award and specifically claiming enhanced compensation. Subsequent representations dated 17.03.2026 and 27.03.2026 were also submitted to the respondents, reiterating the demand for enhancement and requesting that the matter be forwarded to the competent statutory forum.
¶3The learned counsel further submitted that the impugned Award explicitly provides that any objection relating to the determination of compensation may be preferred by way of a written application under Section 64 of the Right to Fair Compensation and Transparency in Land Acquisition, Page3 of 6 Rehabilitation and Resettlement Act, 2013 (Central Act 30 of 2013), and that the Principal District Judge, Tiruvallur, has been designated as the Presiding Officer of the Land Acquisition, Rehabilitation and Resettlement Authority. It is alleged that despite receiving the written objections and subsequent representations, the respondents have failed to perform their statutory duty to refer the matter. Aggrieved by this inaction, the petitioner has preferred this Writ Petition.
¶4In reply, the learned Government Counsel appearing for the respondents submitted that acting upon the petitioner's representations, the respondents have already initiated arrangements to refer the dispute to the competent Civil Court/Authority. She further gave an undertaking to this Court that the reference would be forwarded within a period of two weeks.
¶5Heard both sides and perused the materials available on record.
¶6Considering the facts and circumstances of the case and recording the undertaking given by the learned Government Counsel, this Court directs the first respondent to refer the petitioner's statutory objection/representation dated
29.09.2025, submitted under Section 64 of Central Act 30 of 2013, to the competent Authority / Principal District Judge, Tiruvallur, within a period of two weeks from the date of receipt of a copy of this order. Page4 of 6
