Judgment
ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus forbearing the respondents from altering or modifying the Water Channel/Water Route/Water track in Survey No.252/1 of Veppur Village, Veppur Taluk, Cuddalore District into road or pathway.
¶2The learned counsel for the petitioner submitted that the agricultural land of the petitioner is situated in Survey No. 252/3 and 4 of Veppur Village. The villagers receive water from Periyaeri and Sithaeri in Veppur Village. Water flows through a water channel in Survey No. 252/1 to reach the agricultural lands and extends up to Nagaiyur Village. In such circumstances, the respondents are attempting to convert the said water channel into a road or Page2 of 5 pathway to provide access to layout plots owned by private parties. Aggrieved by this action, the petitioner submitted a representation dated 23.03.2026. However, the same has not been considered to date. Challenging this inaction, the present Writ Petition has been filed.
¶3The learned Government Counsel appearing for the respondents submitted that Survey No. 252/1 of Veppur Village is classified as "Pattai Poramboke" and does not belong to the petitioner. Furthermore, he submitted that the respondents have no intention of converting the water channel into a road as alleged by the petitioner, as the said survey number is Pattai Poramboke and is currently under the occupation of the respondents. The official respondents are taking steps to construct a road for public use
¶4Recording the submission made by the learned Government Counsel, appearing for the official respondents, this Writ Petition stands disposed of
¶5In view of the categorical submission made by the learned Government Counsel that Survey No. 252/1 is classified as Pattai Poramboke, that the said land does not belong to the petitioner, that there is no proposal to convert the existing water channel into a road, and that the road is proposed to be formed Page3 of 5 only in the Government Poramboke land for public use, no further adjudication survives in the present Writ Petition. Recording the said submission, this Writ Petition stands disposed of. No costs. Consequently, connected Miscellaneous Petition is closed. 06-07-2026 Asi To
