Judgment

Order This Writ Petition has been filed to direct the respondents to conduct a fresh survey of the petitioner's property in Survey No. 339/31, and consequently rectify the patta and issue a corrected Field Measurement Book (FMB) sketch in accordance with the petitioner's title documents.

¶2The learned counsel appearing for the petitioner submitted that the petitioner is the absolute owner of the property comprised in Old S.F. No. 339/1, subdivided as S.F. No. 339/31, situated at Kambarajapuram, Thiruvalam Village, Katpadi Taluk, Vellore District. The Encumbrance Certificate also confirms the petitioner's title and possession. However, discrepancies have arisen between the measurements reflected in the Title Deed and the FMB/revenue records. The online patta records also reflect these inconsistencies. Hence, the petitioner submitted a detailed representation dated

24.07.2025 to the authorities, seeking correction of the patta and FMB measurements. The competent authority, vide proceedings dated 01.09.2025, directed the officials concerned to take appropriate action. However, the respondents failed to conduct a proper survey or rectify the discrepancies in the revenue records. The learned counsel further contended that the correction of the FMB and patta necessarily requires a fresh field survey in the presence of the petitioner and after issuing notice to the adjacent landowners; however, no Page3 of 6 such survey has been conducted by the respondents. Aggrieved by the inaction, the petitioner has approached this Court.

¶3The learned Government Counsel appearing for the respondents submitted that the respondents will conduct a fresh survey of the petitioner's property to rectify the discrepancies and issue a corrected Field Measurement Book (FMB) sketch.

¶4Heard both sides and perused the materials available on record.

¶5In view of the above submissions, this Court, without expressing any opinion on the merits of the case, directs respondents 2 to 4 to consider the petitioner's representation dated 24.07.2025, conduct a fresh survey of the petitioner's property comprised in Old S.F. No. 339/1, subdivided as S.F. No. 339/31, situated at Kambarajapuram, Thiruvalam Village, Katpadi Taluk, Vellore District, and demarcate the subject property, based on the Title Deed submitted by the petitioner. This entire exercise shall be completed within a period of twelve (12) weeks from the date of receipt of a copy of this order, after issuing prior notice and affording an opportunity of a personal hearing to the petitioner and other parties concerned. ¶6If any need arises for police assistance, it is open to the respondents to request police protection from the jurisdictional police. If such a request is made, the jurisdictional police is directed to provide adequate police protection for conducting the survey.

¶7In the event of any dispute regarding possession, the official respondents shall not adjudicate upon the question of title. The petitioner and the concerned parties are at liberty to approach the competent Civil Court for recovery of possession and for appropriate reliefs in accordance with law. The official respondents shall not involve themselves in such proceedings or take any action affecting the rights of the parties unless specifically directed by the competent Civil Court.

8.With the above direction, this writ petition is disposed of. No costs. 24-06-2026 Index: Yes/No Speaking/Non-speaking order SK To
