ORDER This petition has been filed seeking to modify the condition imposed in the order dated 30.04.2026 in Crl. O.P. No.10329 of 2026 passed by this Court. Page2 of 5
¶2The learned counsel appearing for the petitioner would contend that the petitioner / accused was arrested and remanded to judicial custody on
06.03.2026 in the above case in RR. No.08 of 2026 for the alleged offences under Sections 8(c) r/w 20(b)(ii)(B), 23(b), 28 and 29 of N.D.P.S. Act and she was released on conditional bail vide order dated 30.04.2026 passed in Crl. O.P. No.10329 of 2026 passed by this Court. Now the petitioner has come forward with this application to modify one of the conditions that is as follows: "5. Accordingly, the petitioner is ordered to be released on bail on her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only), with two blood sureties each for a like sum, to the satisfaction of the Principal Special Court under EC and NDPS Act, Chennai." The learned counsel appearing for the petitioner has filed this petition to modify the said condition since the petitioner's parents were died and since, she has no other blood relatives other than her parents, she was unable to execute the bond though the bail was granted as early as on 30.04.2026.
¶3The learned Government Advocate (Criminal side) appearing for the respondent police would contend that the petitioner was found in possession of
2.537 kgs of Ganja and hence she was arrested and remanded to judicial custody on 06.03.2026 for the alleged offences under Sections 8(c) r/w 20(b)(ii)(B), Page3 of 5 23(b), 28 and 29 of N.D.P.S. Act. Therefore, this modification petition is liable to be dismissed.
¶4Considering the submissions putforth on either side, considering the fact that the petitioner has no other blood relatives other than her parents who are not alive now, I am inclined to modify the condition imposed in Paragraph No.5 to the effect that " the petitioner is ordered to be released on bail on her executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only), with two sureties each for a like sum, to the satisfaction of the Principal Special Court under EC and NDPS Act, Chennai.". The other conditions imposed in the order dated 30.04.2026 in Crl. O.P. No.10329 of 2026 shall remain unaltered. Further, the Magistrate is hereby directed to follow the Rule 14 of Criminal Rules of Practice, while accepting the sureties.
¶5Accordingly, the condition is modified. 13-05-2026 Index: Yes/No Speaking/Non-speaking order ssa Page4 of 5 Note:
