¶2The case of the prosecution is that on 07.04.2026, the deceased, in an intoxicated state, approached in an unstable manner, collided with the petitioner, and fell, thereby sustaining head injuries. The injured person was immediately rushed to the hospital; however, he subsequently succumbed to his injuries on 23.04.2026. Hence, the present case was registered.
¶3The learned counsel appearing for the petitioner submitted that the petitioner is a lorry driver by profession and has not committed any offence as alleged by the prosecution. He further submitted that the petitioner was unacquainted with the deceased and that the incident occurred without any criminal intention. It was further contended that the petitioner is willing to abide by any stringent conditions that may be imposed by this Court. He also submitted that the petitioner has been in incarceration since 24.04.2026 and, therefore, prayed for the grant of bail.
¶4The learned Government Advocate (Criminal Side) appearing for the respondent police, while opposing the grant of bail, reiterated the prosecution's case and submitted that there are no previous cases pending against the petitioner. Page3 of 6
¶5Heard both sides and perused the materials available on record.
