¶2The case of the prosecution is that the de facto complainant was threatened by her ex-husband, and it is suspected that the petitioner set fire to her house. Hence, the case.

¶3The learned counsel for the petitioner submitted that FIR was registered merely on suspicion and even according to the reference in FIR, there are no records identifying the suspect. However in the complaint given by the de facto complainant, she suspected the present petitioner. He further submitted that the petitioner is innocent and he has not committed any offence as alleged by the de facto complainant and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.

¶4The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that according to the investigation it is only accidental fire.

State of Page4 of 5 Kerala [(2005) AIR SCW 5560];
